Terms

The short version: it's your video and your account, credits are yours until you spend them, coaches are paid for the reviews they deliver, and we text you only when you or someone who knows you asked us to.

Who this is between

Apex is operated by Evolve and Thrive AI LLC ("Apex", "we"). Using the Apex app, myapex.coach or coach.myapex.coach means you agree to these terms and to the privacy policy, which explains what we keep and how to delete it.

Your account

You sign in with a one-time code sent to your email address or phone number. There is no password. Keep control of that address and number; anyone who can read your codes can reach your account. An account belongs to one adult. A junior is coached through a parent's or a coach's account.

You can sign out of one device, sign out everywhere, or delete the account from the app at any time. Deleting the account deletes your video and everything derived from it, as described in the privacy policy.

Your video and what Apex makes from it

You own the clips you record or upload. You give Apex a licence to store them, analyse them and show them back to you, to the people you share them with, and to a coach you buy a review from, for as long as the account or the share lasts. We do not publish your clips, sell them, or use them to train models for anyone else.

Scores, measurements and coaching text are estimates produced by software from video. They are training feedback, not medical or safety advice. Play within your own limits.

Only record people who are fine with being recorded, and only invite someone to a clip they appear in. Apex may remove content and close accounts that record or share people against their wishes.

Credits and purchases

Some features are paid for with credits bought in the app or on the website. Credits never expire and are not refundable for cash except where the law requires. Prices are shown before you buy. Purchases through the Apple App Store or Google Play are also subject to those stores' terms and are refunded through them.

Human coaching reviews

When you request a review from a coach on Apex you pay in credits up front. The coach has a set time to accept; if they decline or the time runs out, the credits come back automatically. A delivered review is a written assessment of the stroke you submitted, sometimes with notes pinned to frames of your clip, and is the coach's professional opinion, not Apex's. If a review is not delivered as described, tell us and we will refund the credits.

Coaches on Apex are independent. They set their own prices, are approved by Apex before they can accept work, and are paid by Apex after delivery through our payments provider. Coaches see the clip, score and notes for the stroke you submitted and nothing else from your account, for a limited time after the review closes.

Text messages (SMS program terms)

Program. Apex sends transactional text messages only: one-time sign-in codes you request, and account or coaching notifications you opted into in the app, such as a coach delivering a review you asked for. Apex does not send marketing texts, and does not text numbers entered by anyone other than their owner.

Consent. You consent to receive these messages by entering your own phone number on the Apex app's sign-in screen, where the consent language is shown, and tapping Verify; the code we send confirms the number is yours. The exact wording and screen are published at myapex.coach/sms. Consent to receive texts is not a condition of any purchase.

Frequency and cost. Message frequency varies with your use of Apex and is typically a few messages a month. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.

Opting out. Reply STOP to any Apex text to opt out. You will receive one message confirming the opt-out, and nothing further unless you opt back in by replying START or re-entering your number in the app. Opting out does not close your account; sign-in codes can still reach you by email.

Help. Reply HELP to any Apex text, or write to privacy@myapex.coach.

Privacy. We do not share, sell, or provide your mobile phone number or messaging consent data to third parties or affiliates for marketing or promotional purposes. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. How we handle your number is set out in the privacy policy.

Fair use

Don't break, probe or overload the service, scrape other people's content, impersonate anyone, or use Apex to harass. We can suspend accounts that do.

What we promise, and what we don't

Apex is provided as it is. We work to keep it available and accurate but do not guarantee either, and we are not liable for indirect losses or for anything beyond what you paid Apex in the twelve months before a claim, except where the law does not allow that limit.

Changes

If these terms change in a way that matters to you, we will say so in the app rather than quietly editing the date at the top. Continuing to use Apex after a change means you accept it.
